MEGAPHONE RIGHTS

We would like to introduce the principles of “Megaphone Rights” and “Legislative Privileges” to our political lexicon. The Republican Party is constantly being drawn into debates created by the Left and Republicans will win more if they debate higher principles which help diffuse the Left’s arguments.

Unlike the inalienable rights of “Life, liberty and pursuit of happiness” that emanate from a higher power than ourselves or constitutional rights like the Bill of Rights that are expressly ratified by the people, “Megaphone Rights” are bestowed by simply shouting into a megaphone “We have the right….” Megaphone Rights are declared when there is no other justifiable foundation for a position and they trump both God and the Constitution.

Same sex marriage is an example of a Megaphone Right. Not even all men and women have the “right” to get married (siblings and first cousins cannot marry) and the state can go out of the marriage business altogether, so no one has a “right” to get married.. But, the GLBT community has a “right” to get married that no one else has - a Megaphone Right.

Ratification of Megaphone Rights can be accomplished by Judges. Judges are able to suspend the people’s constitutional right to make law and the people’s right to ratify constitutions so that Judges, in their own wisdom, can grant Megaphone Rights by judicial fiat, a la King George.

The need for Megaphone Rights is always urgent. Traditions that have stood for hundreds of years must be destroyed instantly; there isn’t time for the people to create win/win solutions with the people’s legislative process. Because of the urgency of Megaphone Rights, a group need only hire 100 people to interrupt the constitutional right of a church service and wave signs. The mainstream media then puts the demonstration into every household across America and this is the signal that Judges are waiting for to ratify a Megaphone Right.

A second method for establishing Megaphone Rights is that a Senator can declare them. Health Care, Education, Living Wage, Retirement Income, Unemployment Benefits and Family Leave are all examples of Megaphone Rights declared by Senators. It does not matter that the Constitution is silent or limits Federal Power or that the Federal Government is not even the best source for said activities, a Senator need only say “the people have a right” and the “right” becomes established. Typically, an anecdote is all that is required to trigger a Senator’s declaration. If one little old lady eats dog food, all little old ladies could be in need, so action must be taken and urgently of course.

Obviously, the point is that Republicans really need to push back and limit Megaphone Rights. All states point out with clarity that a driver’s license is a privilege, not a right. The fact is, all government created perks and benefits are privileges, not “rights,” and it would provide great clarity if all Bills started out like the driver’s license – “This is a privilege...” If Senators were required to argue with more justification than “this is a right” when bringing bills to the floor, the Left would have a more difficult time.
